Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Synaptiq platform, including our AI-powered sales automation services, APIs, and related tools (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Synaptiq provides an AI-powered sales agent that qualifies leads, answers visitor questions, and books meetings autonomously through an embeddable chat widget and administrative dashboard. The Service includes lead management, CRM integrations, analytics, and automated follow-up capabilities.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to reverse engineer, decompile, or extract the source code of the Service or its AI models.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to send unsolicited communications (spam) or engage in deceptive practices.
  • Share your account credentials with unauthorized parties.
  • Exceed any rate limits or usage quotas associated with your subscription plan.

4. Subscription and Billing

4.1 Plans and Pricing

The Service is offered on a subscription basis. Current pricing and plan details are available on our pricing page. We reserve the right to modify pricing with 30 days advance notice.

4.2 Payment Terms

Subscription fees are billed in advance on a monthly or annual basis depending on the plan selected. All fees are non-refundable except as required by law or as explicitly stated in these Terms. Payment processing is handled by Stripe.

4.3 Cancellation

You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date.

5. Data Ownership

5.1 Your Data

You retain all rights to the data you input into the Service, including lead information, conversation data, and CRM records ("Your Data"). You grant us a limited license to process Your Data solely to provide and improve the Service.

5.2 AI-Generated Content

Content generated by our AI (chat responses, lead qualifications, meeting summaries) is provided as part of the Service. You may use AI-generated content in connection with your business operations. We do not guarantee the accuracy of AI-generated content.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

7. Limitation of Liability

To the maximum extent permitted by law, Synaptiq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Synaptiq and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine to be harmful to the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately. You may export Your Data within 30 days of termination.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Any disputes shall be resolved in the courts located in Wilmington, Delaware.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service. Continued use after changes take effect constitutes acceptance.
